Germany Flag
Germany's flag is made up of three horizontal bands of equal size in the colors black, red, and gold. These colors have been linked with Germany since the mid-nineteenth century, and they were originally officially approved as the national flag by the Weimar Republic, which existed from 1919 to 1933. They were also used by the German Democratic Republic from 1949 to 1990, and the Federal Republic of Germany has used them from its founding in 1949.
There is also a rival history of adopting the colors black, white, and red as the national colors of Germany, which was established in the constitution of the North German Confederation in 1867. From 1870 until 1918, the German Empire employed these colors, which were eventually adopted as the Nazi Party's official colors, along with the swastika flag, in 1933. Despite this background, the use of the colors black, white, and red is not prohibited in Germany, while appropriate Nazi emblems are.
Defamation of Germany's black, red, and gold flag is a criminal crime under German penal code section 90, punishable by a fine or up to five years in prison. The flag is protected against defamation because it is an official symbol of the country's constitutional order.
